RIZE UP HOME CARE Medical Equipment Rental Agreement (updated 4/1/2025)


1. Definitions

  • "Medical Equipment" refers to any item rented under this agreement.
  • "Renter" refers to the individual or entity entering into this agreement with Rize Up Home Care.
  • "Rent-To-Own Program" refers to an arrangement where ownership is transferred to the Renter upon full completion of all installment payments.

2. Ownership and Condition

The medical equipment is the property of Rize Up Home Care and is provided in good working condition. Renter agrees to return the equipment in the same condition as received, excluding normal wear and tear, at the end of the rental period or sooner upon demand by Rize Up Home Care, with reasonable notice unless in cases of misuse or breach of contract. All returns are subject to inspection.


3. Use and Restrictions

The following restrictions apply to the use of all medical equipment:

  • Equipment shall not be used by individuals under the age of 18.
  • Equipment shall not be used under the influence of intoxicants or narcotics.
  • Equipment shall not be operated in an unsafe or negligent manner.
  • Equipment shall only be used for its intended medical purpose and in accordance with manufacturer guidelines.

Renter agrees to operate the equipment with reasonable care and diligence and to comply with all laws and instructions for use.


4. Maintenance and Malfunction

Renter is responsible for basic maintenance, including battery charging, cleaning, and safe storage. Renter agrees not to attempt repairs or alterations without written permission from Rize Up Home Care. In the event of equipment malfunction not due to misuse or neglect, Rize Up Home Care will, at its discretion, repair or replace the item within a reasonable time.


5. Liability and Indemnification

Renter assumes all risk and liability for any loss, damage, or injury, including death, arising from the use, operation, or transport of the equipment.

Renter agrees to:

  • Hold harmless and indemnify Rize Up Home Care, its agents, officers, and employees from all claims arising out of use or possession of the equipment.
  • Assume all costs, including, but not limited to, reasonable attorney’s fees, court costs, and related expenses for defense and indemnification related to such claims.

Rize Up Home Care is not responsible for loss of or damage to any property left on or transported by the equipment.


6. Damage, Loss, or Theft

Renter is financially responsible for any damage, loss, theft, or destruction of the medical equipment. Rize Up Home Care reserves the right to charge the credit card on file for any necessary repair or full replacement costs. Replacement costs will be based on the current retail value of the equipment or as determined by Rize Up Home Care.


7. Insurance

Renter is encouraged to maintain homeowner’s, renter’s, or other applicable insurance covering the rented medical equipment.


8. Notification of Accidents

Renter shall notify Rize Up Home Care immediately, via phone or email within 24 hours, of any accidents, damage, or equipment malfunctions.


9. Repossession Rights

Rize Up Home Care reserves the right to repossess the equipment without notice if it is used in violation of this agreement or not returned by the due date. Repossession shall be conducted in compliance with applicable laws.


10. Payment Terms

Monthly rental items will be charged on the re-rental date of each month until returned. Additional charges will apply for late returns. Renter agrees to keep a valid credit card on file and authorizes Rize Up Home Care to charge the credit card on file for any outstanding payments, damages, or losses.


11. Payment Authorization

By accepting this agreement, the Renter:

  • Certifies they are an authorized user of the provided credit card.
  • Authorizes Rize Up Home Care to charge the card for rental fees, repair, or replacement costs as outlined.
  • Agrees not to dispute any charges consistent with this agreement.

12. Rent-To-Own Terms

This agreement remains in effect until:

  • The Renter returns the equipment in acceptable condition, or
  • The Renter completes all required payments under a Rent-To-Own program, at which time ownership is transferred to the Renter.

13. Early Returns

An Early Return is considered a return that takes place before the Renter completes all required payments for the Rent-To-Own program. Early Returns may be made at the discretion of the Renter at any time. Any payments made prior to the Early Return will be treated as non-refundable rental fees for time equipment was in the Renter’s possession.


14. Legal Fees and Enforcement

Renter agrees to pay all costs and attorney’s fees incurred by Rize Up Home Care in recovering equipment, enforcing this agreement, or collecting payments due.


15. No Agency Relationship

Neither the Renter nor any person operating the equipment shall be deemed an agent or employee of Rize Up Home Care.


16. Successors and Assigns

This agreement is binding upon the Renter’s heirs, executors, administrators, and personal representatives.


17. Force Majeure

Rize Up Home Care shall not be liable for any failure to perform due to causes beyond its reasonable control, including but not limited to acts of God, fire, flood, or governmental restrictions.


18. Right to Refuse Service

Rize Up Home Care reserves the right to refuse rental service to any individual for any reason deemed necessary.


19. Acknowledgement

By accepting this agreement, I confirm that I have read and understood the terms and conditions and agree to abide by them fully.
